Terms of Use

    1. Who we are and what you are agreeing to

    These Terms of Use are an agreement between you and OCIM Group, the operator of the fromCom app and the fromcom.ai website ("fromCom", "we", "us"). By creating an account or using fromCom, you accept these terms and our Privacy Policy. If you do not agree, do not use fromCom.

    2. What fromCom is

    fromCom is an AI-powered assistant that connects to your WhatsApp account and helps you stay on top of your chats. It reads the conversations you choose, finds tasks, commitments and follow-ups, and helps you act on them with reminders, calendar events, summaries and message drafts. fromCom is a productivity tool. It is not a messaging app, and it does nothing with your chats except what you ask it to.

    3. fromCom and WhatsApp

    fromCom connects securely to your WhatsApp account in order to provide the service.

    • fromCom is an independent product. It is not affiliated with, endorsed by, or sponsored by WhatsApp LLC or Meta Platforms, Inc. "WhatsApp" is a trademark of its owner.
    • Your WhatsApp account stays yours. You may only link a WhatsApp account that belongs to you, and your use of WhatsApp remains governed by WhatsApp's own terms of service.
    • There is a risk you accept. WhatsApp decides how it treats accounts that use third-party tools, and linking any third-party app, including fromCom, may lead WhatsApp to warn, restrict, or ban your account. We work to keep fromCom's behavior conservative, but we cannot control WhatsApp's decisions and we are not liable for any suspension, restriction, or loss of your WhatsApp account, or for changes WhatsApp makes that limit or break fromCom's functionality.

    4. Who can use fromCom

    You must be at least 18 years old, or the age of majority where you live, whichever is higher, and legally able to enter into this agreement.

    5. Your account

    You agree to provide accurate information when creating your account and to keep your sign-in credentials secure. You are responsible for activity that happens under your account unless it results from our fault. Tell us at contact@fromcom.ai if you believe your account has been compromised.

    6. Your license to use fromCom

    We grant you a personal, non-exclusive, non-transferable, revocable license to use the fromCom apps for your own personal or internal business use, subject to these terms and to the plan you are subscribed to. For the app downloaded from Apple's App Store, this license is limited to use on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's App Store terms.

    7. What you may not do

    You agree not to:

    • use fromCom to send spam, bulk or automated messages, or any unlawful, deceptive or abusive communications;
    • link a WhatsApp account that is not yours, or use fromCom to access, monitor, or record another person's communications unlawfully or without any consent the law requires;
    • resell fromCom, offer it as a service to others, or provide access to third parties;
    • reverse engineer, decompile, or attempt to extract fromCom's source code, models, or prompts;
    • scrape, mass-export, or systematically extract data from the service, or build a product on top of it without our written permission;
    • interfere with the operation or security of the service.

    We may suspend or terminate accounts that violate this section.

    8. AI makes mistakes

    fromCom's results are generated by artificial intelligence. They may be incomplete, inaccurate, or wrong, and fromCom may miss items entirely. fromCom is a helper, not a guarantee:

    • Do not rely on fromCom as your only system for tracking obligations that carry serious consequences, such as legal deadlines, medical matters, or financial commitments.
    • fromCom does not provide legal, medical, financial, or other professional advice.
    • You are responsible for reviewing your own conversations and verifying anything important.

    9. Reminders, calendar events and summaries

    Reminders, calendar events, notifications and chat summaries are provided on a best-effort basis. They may fail to fire, arrive late, or contain errors or misinterpretations. Always verify dates, times and details against the original conversation. To the extent permitted by law, we are not liable for consequences of a missed, late, or inaccurate reminder, event, or summary.

    10. Messages sent through fromCom

    Some features let you send WhatsApp messages, such as approving a drafted reply, sending a nudge, or scheduling a message. These messages are sent from your own WhatsApp account, only after your explicit action, and are treated as sent by you. Review every message before you approve it. You are responsible for the content of messages you send.

    11. Your content and your data

    • You own your content. Your messages, chats, and the items fromCom creates from them belong to you. We claim no ownership of them.
    • Our license is minimal. You grant us only the limited right to process your content as needed to provide the service to you, as described in the Privacy Policy.
    • Message content is short-lived. Message content processed on our servers is deleted within 24 hours. We actively delete it; we do not archive it.
    • Derived items persist for you. Tasks, reminders, and related items fromCom creates, and your account data, are kept so the service works across your devices, until you delete them or delete your account.
    • No training. We do not use your content to train AI models, and our agreements with AI providers prohibit them from training on it.
    • Deleting everything is one action. You can delete your account and all associated data from the app at any time.

    The Privacy Policy is the authoritative description of what we collect, store, and delete.

    12. Subscriptions and payment

    fromCom offers free and paid plans. Paid subscriptions are purchased exclusively through Apple's App Store or Google Play:

    • Subscriptions renew automatically until cancelled. Cancel any time in your App Store or Google Play subscription settings; cancellation takes effect at the end of the current billing period.
    • Refunds are handled by Apple or Google under their policies. We do not process payments and never see your payment details.
    • If a free trial is offered, it converts to a paid subscription unless cancelled before the trial ends.
    • We may change plan features or prices; changes to your price apply only at your next renewal and after notice through the store or the app.

    13. App store terms

    If you downloaded fromCom from Apple's App Store, the following applies: these terms are between you and us, not with Apple, and we, not Apple, are solely responsible for the app and its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price you paid for it, if any; to the maximum extent permitted by law, Apple has no other warranty obligation for the app. Apple is not responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, consumer protection claims, or claims that the app infringes a third party's intellectual property rights; we are solely responsible for the investigation, defense, and resolution of any such claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.     14. Ending the agreement

    You can stop using fromCom and delete your account at any time from Settings. We may suspend or terminate your access if you materially breach these terms, if we are required to by law, or if we discontinue the service, with reasonable notice where practicable. On termination your license ends and your data is handled as described in the Privacy Policy. Sections that by their nature should survive termination, including sections 15 to 17 and 19, survive it.

    15. No warranty

    fromCom is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that fromCom will be uninterrupted, error-free, or that it will identify every task or commitment in your conversations.

    16. Limitation of liability

    To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill. Our total liability for all claims under these terms is limited to the greater of the amounts you paid us in the 12 months before the claim, or 50 USD. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including where applicable liability for willful misconduct, gross negligence, or death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

    17. Your responsibility to us

    You will compensate us for losses and reasonable costs arising from your breach of these terms or your unlawful use of the service, except to the extent we caused them.

    18. Changes to these terms

    We may update these terms. For material changes we will give at least 7 days' notice in the app or by email before they take effect. If you keep using fromCom after that, the new terms apply. If you do not agree, stop using the service and delete your account.

    19. Governing law and disputes

    These terms are governed by the laws of the State of Israel, and disputes will be brought in the competent courts of Tel Aviv, Israel. If you are a consumer, nothing in this section deprives you of the protection of mandatory consumer laws of your country of residence, or of your right to bring proceedings in your local courts where that right cannot be waived.

    20. General

    If any part of these terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver of it. You may not assign this agreement; we may assign it to a successor or affiliated entity that continues operating fromCom, and will notify you if we do. These terms, together with the Privacy Policy, are the entire agreement between you and us about fromCom.
